Effective date: October 23, 2026
These Terms of Service (“Terms”) are a binding agreement between you and Phillip Chin, an independent licensed insurance broker (NPN #8895251), doing business as Plan with Phil (“we,” “us,” or “our”). They cover your use of planwithphil.com and quote.planwithphil.com (the “Site”) and any quotes, tools, forms, or services we provide through it. By using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.
PLEASE READ SECTION 21 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION, AND IT WAIVES CLASS ACTIONS AND JURY TRIALS. YOU MAY OPT OUT WITHIN 30 DAYS AS EXPLAINED IN THAT SECTION.
1. Who we are
Plan with Phil is an independent insurance broker. We are not an insurance company, and we don’t issue policies, set rates, or pay claims. We compare life and disability insurance products from multiple carriers and help you apply.
2. Who can use the Site
You must be at least 18 years old and a resident of the United States to request quotes or apply for coverage through the Site. We sell insurance only in states where we are licensed. See our State Licenses page. Not every product or carrier is available in every state.
3. How we’re paid
We don’t charge you a broker fee. When a policy is issued, the insurance carrier pays us a commission. Some carriers also pay bonuses or other compensation based on the overall volume or quality of business we place with them. This compensation is built into carrier pricing; it isn’t added to your premium because you used us.
4. Quotes are estimates and can change
Quotes on the Site are estimates based on the information you provide and the carrier rates available at that moment. Your final premium, rate class, and eligibility are decided by the carrier after underwriting, which may include a medical exam, medical records, prescription history, driving records, and other checks. A quote can change if your age changes before you apply (for example, after a birthday), if the carrier updates its rates, or if underwriting reveals different information.
5. No guarantee of the lowest price
We work to compare a wide range of carriers, but we don’t guarantee that any quote is the lowest available anywhere or that every carrier or product is shown. The decision to buy, and which policy to buy, is yours.
6. No coverage until approved
Submitting a quote request or application does not create insurance coverage. Coverage begins only when the carrier approves your application, issues the policy, and the first premium is paid, as stated in the policy. Don’t cancel any existing coverage until your new policy is in force.
7. The carrier is responsible for your policy
Once a policy is issued, the carrier is responsible for your coverage, billing, and claims, and the policy itself controls your benefits and rights. We’re happy to help you work with your carrier, but we can’t change policy terms or approve or deny a claim.
8. Not financial, legal, or tax advice
Content on the Site is general education. It isn’t personal financial, legal, or tax advice. For advice about your situation, speak with a qualified professional. You’re welcome to call us about your insurance options.
9. Information you provide
You agree that the information you give us is true, complete, and your own, or that you’re authorized to provide it. Inaccurate or incomplete answers can lead to wrong quotes, a declined application, or a policy being rescinded or a claim being denied later.
10. Consent to contact
When you submit your contact information, you agree that Plan with Phil may contact you about your quote, application, and related insurance services by phone, text message, and email at the numbers and addresses you provide, including by automated technology or prerecorded messages. Consent isn’t a condition of purchase. Message and data rates may apply, and message frequency varies. You can opt out of texts anytime by replying STOP, unsubscribe from emails using the link in any email, or ask us to stop calling by contacting us.
11. Electronic records and signatures
You agree that we may provide disclosures, notices, applications, and other documents to you electronically, and that these satisfy any requirement that they be in writing. You agree that your electronic signature (for example, through DocuSign) has the same legal effect as a handwritten signature. You may request paper copies, or withdraw your consent to electronic records, by contacting us. If you withdraw consent, we may not be able to complete an application online.
12. Third-party services
The Site uses third-party tools, such as our quote engine, e-signature, and analytics providers, and links to carrier and other websites. We don’t control and aren’t responsible for third-party content, services, or practices, and your use of them may be subject to their own terms and privacy policies.
13. Acceptable use
You agree not to: submit false information or information about someone else without permission; use bots, scrapers, or other automated tools to access or copy the Site; try to gain unauthorized access to the Site or our systems; overload, disrupt, or introduce harmful code into the Site; or use the Site for any unlawful purpose.
14. Intellectual property and feedback
The Site’s content, design, logo, and the “Plan with Phil” name belong to us or our licensors and are protected by copyright and trademark law. You may view and share pages for personal, non-commercial use. You may not copy, modify, or reuse them otherwise without our written permission. If you send us ideas, suggestions, or feedback, we may use them without any obligation to you.
15. Linking to the Site
You may link to our homepage in a fair and lawful way. You may not frame our pages on another site or link in a way that suggests we endorse or are affiliated with you when we aren’t.
16. Suspending access
We may change, suspend, or discontinue any part of the Site at any time, and we may block or restrict access for anyone who violates these Terms or misuses the Site.
17. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON’T GUARANTEE THAT THE SITE WILL BE ACCURATE, COMPLETE, SECURE, ERROR-FREE, OR UNINTERRUPTED.
18. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some states don’t allow these limits, so they may not apply to you. Nothing in these Terms limits any rights you have under insurance law, under the terms of a policy you purchase, or that can’t be limited by law.
19. Indemnification
You agree to defend and hold us harmless from any claims, losses, and costs (including reasonable attorney’s fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of another person.
20. Informal resolution first
Before starting arbitration or any other proceeding, you and we each agree to try to resolve the dispute informally. The party with a concern must send a written notice describing the issue and the relief requested to the other party (our address is in Section 24). If the dispute isn’t resolved within 30 days after the notice is received, either party may proceed under Section 21.
21. Arbitration agreement and class action waiver
Binding arbitration. Except as stated below, any dispute, claim, or controversy between you and us arising out of or relating to the Site, these Terms, our communications with you, or the services we provide (“Dispute”) will be resolved by final and binding individual arbitration, not in court. This agreement is governed by the Federal Arbitration Act.
Rules and fees. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (available at adr.org), before a single arbitrator. Fees will be paid as those rules provide. The arbitration may be held by phone, video, or written submissions, or in person in the county where you live or another location we both agree to. The arbitrator may award the same individual relief a court could award, but only to you individually.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may also go to court to stop infringement of intellectual property. This agreement does not cover disputes about the terms, benefits, or claims of an insurance policy, which are between you and the carrier and governed by the policy and applicable law, or any claim that by law cannot be required to go to arbitration.
Class action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine more than one person’s claims.
Jury trial waiver. IF A DISPUTE PROCEEDS IN COURT FOR ANY REASON, YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.
30-day right to opt out. You may opt out of this arbitration agreement by sending us a written notice within 30 days after you first use the Site or first submit information to us. Include your name, mailing address, and a clear statement that you want to opt out of arbitration, and send it by email to info@planwithphil.com or by mail to the address in Section 24. Opting out won’t affect any other part of these Terms.
Severability. If the class action waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court, not arbitration. If any other part of this section is found unenforceable, the rest of it still applies. This section survives after you stop using the Site.
22. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, and by the Federal Arbitration Act for Section 21. For any Dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Queens County, New York, except for small claims actions, which may be brought where you live.
23. Changes to these Terms
We may update these Terms from time to time. The effective date above shows the latest version, and changes apply from the date they’re posted. Continuing to use the Site afterward means you accept the updated Terms. Changes to Section 21 won’t apply to any Dispute we already knew about before the change.
24. General terms and contact
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site. If any provision can’t be enforced, the rest remains in effect. Our failure to enforce a provision isn’t a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of our business. The Site is intended for use in the United States only.
